This Criminal Petition is filed under Section 438 Cr.P.C. seeking to grant anticipatory bail to the petitioner-accused in crime No.282 of 2017 of Sulthanabad police station, Peddipalli District registered for the offences punishable under Sections 420, 465, 468 & 471 IPC.

Heard the learned counsel for the petitioneraccused, the learned Additional Public Prosecutor and perused the material available on record.

The learned counsel for the petitioner-accused would submit that the petitioner-accused has not fabricated or forged signature of Tahsildar and he is not responsible for any of the offences alleged in this crime, and ultimately, prayed to allow the application.

On the other hand, the learned Additional Public Prosecutor appearing for the respondent-State opposed the grant of bail to the petitioner-accused under Section 438 Cr.P.C. and contended that the petitioner-accused gave a confessional statement to the Tahsildar, Sultanabad on 04.12.2017 admitting that he fabricated the proceedings by forging signatures of the Tahsildar and transferred the land which was in the name of his grand father in the name of his father for the purpose of obtaining loan. The allegations also go to show that the petitioner-accused fabricated pattadar pass book forging signature of the Tahsildar. As per the records, the petitioner-accused is a Village Revenue Assistant. He is not supposed to indulge in such activities. In the circumstances of the case, it cannot be held that the petitioner is innocent person and he has nothing to do with

the alleged crime. The matter requires investigation. Release of the petitioner on bail would hinder investigation. Under these circumstances, the petitioner is not entitled to bail under Section 438 Cr.P.C. The Criminal Petition is devoid of merit and liable to be dismissed.
