SMT JUSTICE T.RAJANI CRIMINAL PETITION No.24789 OF 2017 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioners, who are accused Nos.1 and 2, in Crime No.163 of 2017 on the file of III Town Police Station, Nandyal, Kurnool District. The offences alleged are under Sections 420, 465, 417, 442, 354 and 307 of I.P.C. and Section 156(3) of Cr.P.C.

Heard the learned counsel for the petitioners, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.

The allegation against the petitioners is that they trespassed into the de-facto complainant's house with weapons and tried to murder him; when his mother intervened, they abused her in filthy language and tried to outrage her modesty, but the people there rescued the de-facto complainant and his mother from the hands of the petitioners. Hence, from the above allegations, this Court opines that this is not a fit case for grant of anticipatory bail to the petitioners/accused Nos.1 and 2. The certificate dated 17.11.2017, issued by the office of the Senior Section Engineer, South Central Railway, Guntur Division, on which the petitioners' counsel relies, shows that the 1st petitioner being Office Superintendent, attended his office at Guntur. The said certificate cannot be taken into consideration at this stage, more so when the genuineness of the same is disputed by the Public Prosecutor, and that does not belie the fact that the 1st petitioner participated in the offence.

Hence, in the above circumstances, the petitioners/accused Nos.1 and 2 are directed to surrender before the Court and obtain regular bail.

TR,J Crl.P. No.24789/2017 Accordingly, with the above observation, this Criminal Petition is dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
