This writ petition is filed challenging the order in proceedings in Rc.No.RDONDL-MIS/65/2017-DT(NDL), dated 31-10-2017, wherein and whereby, the petitioner's fair price shop authorization is suspended pending enquiry. Learned counsel for the petitioner submits that variations regarding rice are within permissible limits and she also submits that the appeal was filed against the impugned order on 30-01-2017 along with stay petition. But no orders are passed on the same.
On the other hand, learned Assistant Government Pleader for Civil Supplies submits that variations are not within permissible limits.
It is to be seen that it is only suspension pending enquiry.
Though the impugned order is passed on 31-10-2017, the respondents have not issued any show-cause notice for conducting further enquiry.
In view of the same, the appellate authority is directed to dispose of the stay petition in the appeal within a period of two weeks from the date of receipt of a copy of this order and 3rd respondent is directed to complete the enquiry within a period of four weeks from the date of receipt of a copy of this order. If the enquiry is not completed within the aforesaid period, impugned order of suspension stands suspended and
the petitioner is permitted to supply the stocks till enquiry is completed.
Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
