HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.8772 OF 2003 ORDER:

When the matter is taken up for hearing, it is noticed that the petitioners have retired from service on attaining the age of superannuation and that none appeared for the petitioners in spite of the fact that the writ petition is listed under the caption 'for dismissal', In this writ petition, the action of the 2nd respondent in purporting to re-fix the petitioners' pay and effect recovery of amount from the salary of the petitioners vide proceedings dated 08.04.2003, is under challenge. This Court, while admitting the writ petition on 02.05.2003, granted interim stay of recovery of amount from the petitioners. Thereafter, vide orders dated 03.11.2003, interim stay granted on 02.05.2003 was made absolute.

No counter affidavit is filed on behalf of the 2nd respondent who issued the impugned proceedings.

In view of the aforesaid interim orders, this Court is of the considered view that no further orders are necessary in this writ petition and the writ petition is accordingly closed. No order as to costs.
