This civil miscellaneous appeal is preferred challenging the order dated 15.11.2003 in E.A. No.67 of 2003 in E.P. No.45 of 2003 in O.S. No.469 of 1993 on the file of I Additional Senior Civil Judge, Visakhapatnam (E.A. No.1288 of 2000 in E.P. No.471 of 1999 in O.S. No.469 of 1993 on the file of II Additional Senior Civil Judge Court, Visakhapatnam).

2. When the matter is taken up for hearing, learned counsel for the appellant submitted that the very purpose of filing of the civil miscellaneous appeal became infructuous.

The submission is recorded.

3. Accordingly, the civil miscellaneous appeal is dismissed as infructuous.

Miscellaneous petitions, if any pending in this miscellaneous appeal, shall stand closed.
