This Application is moved for relaxation of the condition no.(b), which reads as follows:

"b) The applicant/accused shall not participate in the administration, shall not take part in the financial matters and also to restrain from attending the board meetings of the APMC, till the trial is over"

The learned counsel for the applicant/accused has submitted that the applicant/accused has resigned from the post of Chairmanship and he shall not pressurize or contact in any manner the witnesses of APMC.

Learned APP while opposing this Application for relaxation of condition no. (b), has submitted that Board of Directors have passed No Confidence Motion against the applicant/accused. All the witnesses are employed in APMC.

Considering the nature of the offence committed by the applicant/accused, condition No. (b) cannot be relaxed entirely but it can be modified as follows:

"The applicant/accused shall not participate in the administration and is restrained from attending the board meetings of the APMC for a period of 3 years from today. However, he shall not take part in the financial matters till the trial is over."
