The petition is filed seeking directions to the respondent to investigate into FIR No.5 of 2016 registered with Chandan Nagar Police Station, Pune, in its true letter and spirit. Mr. Yagnik, learned APP, on instructions, makes a statement that the crime is investigated and a decision to file "B" summary is taken. In view of the statement, Mr. Patil, learned counsel for the petitioner, seeks leave to withdraw the petition with liberty to contest the "B" summary report.
