By this petition, the petitioner challenges the order of Respondent No.2 - Returning Officer dated 31.12.2014 rejecting the nomination form of the petitioner.

The petitioner filed the nomination for contesting the by-election to the Pimpri-Chinchwad Municipal Corporation. The nomination form of the petitioner was rejected by the Returning Officer by the impugned order dated 31.12.2014.

The elections are scheduled on 18.1.2015 and the last date for withdrawal of nomination was 2.1.2015. On 3.1.2015, the symbols have been allotted to the eligible candidates.

wp.35.2015_903.doc In view of the aforesaid, it would not be possible for this Court to entertain the writ petition and interfere with the election process at this stage. In view of the Constitutional bar in entertaining the matters challenging the election process, the petition is liable to be dismissed. The same is dismissed as such, with no order as to costs. (C.V.
