Though the application has been made for condonation of the delay in filing an application for leave to appeal, it transpired that the Appeal that is being filed is by virtue of the proviso to section 372 of the Code of Criminal Procedure. A view has been taken by this Court that for such Appeal, no specific time limit is prescribed. A view has also been taken that no leave for filing such an Appeal is necessary.

As such, it is not necessary to pass any order condoning the delay on this application.
