Though, the respondents are duly served, no one appeared on behalf of them when the matter called out.

This Application is for condonation of 51 days delay in preferring the First Appeal challenging the Judgment and Award dated 17.10.2012 passed by the learned 2nd Joint Civil Judge, Senior Division, Nashik in L.A.R. No. 87 of 2006.

Considering the submissions made by the learned AGP for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

i) Civil Application is allowed in terms of prayer clause (b) which read thus :

"b) This Hon'ble Court be pleased to condone the delay of 51 days in filing the abovementioned First Appeal against the judgment and award dated 17.10.2012 passed by the learned 2nd Joint Civil Judge, Senior Division, Nashik in L.A.R. No. 87 of 2006."

ii) Civil application stands disposed off accordingly.
