By this application the State seeks cancellation of bail granted to the applicant vide order dated 20-6-2014. The application is founded on the contention that the respondent has violated the condition of bail, precisely not to enter the area under the jurisdiction of Kandivali police station. Besides filing of an N.C. Complaint, lodged by the father of the

sjs 40-APPLN-2.2015 victim, no material has been placed before the Court for prima facie coming to the conclusion of the respondent having breached the condition of bail. Needless to add that the application does not reveal that in spite of said condition being imposed and the police having obtained permission from Magistrate and investigated the matter and/or collected any other material in support of the contention taken in the application. Needless to add, the parameters of grant of bail and parameters for cancellation of bail are altogether different. No case of the applicant having violated the condition being made out, the application stands rejected.
