Heard. This is an application seeking condonation of delay caused in filing the appeal challenging therein the judgment and order dated 31.8.2015 passed by the Addl. Sessions Judge. Pune, in Sessions Case No.49 of 2010. The applicant is convicted for the offence punishable under Section 304(II) of Indian Penal Code and under 323 of IPC. There is delay of 69 days in filing the appeal.

For the reasons assigned in paragraphs 7, 8 and 9, the
Mhi 2 APPA-28-29-16.sxw application seeking condonation of delay deserves to be allowed. The delay of 69 days is condoned in the interest of justice. The application is allowed in terms of prayer clause (a). The application stands disposed of. 3.
The applicant is at liberty to circulate the matter upon the appeal being registered.
