In view of this, learned counsel for the applicant seeks liberty to withdraw the application with further liberty to approach the Court of Sessions under section 439 of Code of Criminal Procedure, 1973. 2) Liberty as prayed for is granted. Learned Sessions Judge shall not be influenced by the withdrawal of this application, since it has been withdrawn only due to change in circumstances. Application filed by the present applicant be decided on its own merits.
