Perused the office remarks. It is noticed that Respondent Nos.5, 40, 61, 2A are reportedly dead. In spite of conditional order dated th June 2010, no steps have been taken. The appeal is abated as against the said respondents. The office remark further indicates that quite a few respondents out of the 106 respondents have not been served so far in spite of the conditional order. As a result, the appeal has

40 fa.12.10 anr been dismissed as against the said respondents. Realizing this position, counsel for the Appellant seeks time to take necessary steps. That be done within twelve weeks from today, failing which the entire appeal shall stand dismissed for non-prosecution without further reference to the Court. If steps are taken in time, the appeal be listed on 16 th November, 2010 for admission.
