Considering that the impugned order passed by the Trial Court is of the year 2015 and it was of rejection of the Notice of Motion and during pendency of this Appeal, no relief was granted to the Appellant; moreover, having regard to the fact that the Suit is of the year 2009, learned counsel for the Appellant fairly concedes that, instead of deciding this Appeal, hearing of the Suit itself may be expedited. 3.

In view thereof, the Appeal stands disposed off as withdrawn. The hearing of the Suit is expedited.
