The learned counsel for respondent No.2 submits that respondent No.2 herein, who happened to be the original complainant in C.C. No.819/1997 has expired during the pendency of this Petition. Process was issued against the petitioner under Section 500 of the Indian Penal Code. Due to the demise of the complainant, the criminal case itself would not survive.

In view of this, the Petition stands disposed of as the case

Mhi 2 WP-85-2003.sxw stands abated due to the demise of the original complainant. The Petition is accordingly disposed of.
