The application was rejected on the ground that the Petitioner has not been granted parole or furlough earlier. This ground is no longer tenable in view of the decision of this Court in Criminal Writ Petition No.2115 of 2021 and Ors. dated 28 October 2021, however now this issue does not survive as the learned APP

940. WP 2939.21.doc has placed on record the order dated 7 June 2021 granting emergency parole to the Petitioner.

In the light of this order granting emergency parole to the Petitioner, nothing further survives in this Petition which is accordingly disposed of.
