None appears for the Petitioner. We have, however, heard learned APP for the Respondent-State. The petition is filed for further investigation in CR. No.53 of 2009 registered with Kherwadi, Bandra Police Station.

Learned APP, on instructions, states that the said FIR was investigated and thereafter on 23rd June 2009 charge-sheet was filed before the Metropolitan Magistrate, 32nd Court, Bandra, Mumbai. She further submitted that learned Magistrate has framed charge in the same case on 5th September 2013.
