This is an application through jail, wherein the applicant has prayed that his case be expedited. He has stated that for the appointment of the Special Public Prosecutor in the said case, the case was delayed and he has made several allegations in the said application, dated 30th November, 2015.

Ms.Sawant, learned counsel appointed as Amicus Curiae, for the applicant has enumerated the various grounds on which this application has been filed.

Learned APP has tendered a letter dated 4th April, 2016, addressed by the Special Public Prosecutor to the Senior P.I, Shivaji Nagar Police Station, Ambarnath, wherein it is stated that one of the accused has till date not engaged an advocate and that he was seeking time. He has stated that the witnesses in the said case were coming to the Court, however, they could not be examined, as time was sought by the accused - Bhalchandra R. Bhoir. Be that as it may, the incident is of 6th May, 2011. Charge is framed and one witness has been examined so far. 4.

Considering the fact, that the trial has already commenced, the learned Additional District and Sessions Judge, Kalyan, who is seized of the case is requested to expedite the said case and dispose of the same as expeditiously as possible and preferably within one year from the date of receipt of this order.

The Commissioner (H.Q), Thane, to take effective steps to ensure that all the accused in the said case are produced on all the dates given by the Trial Court.

Accordingly, the Application is disposed of with the aforesaid direction.

Registry to communicate the above order to the learned Additional District and Sessions Judge, Kalyan, who is seized of the said case. A copy of the said order also be forwarded to the applicant, who is lodged in Taloja Central Prison. Registry as well as learned APP to also communicate the above order to the Commissioner (H.Q), Thane. 8.

All concerned to act on the authenticated copy of this order.
