Challenge is to the notice issued by the Collector, Mumbai Suburban, State Excise, which is at Exhibit-G. Obviously, Article 227 of the Constitution of India cannot be invoked for challenging the said notice. Therefore, this petition shall be treated as the one under Article 226 of the Constitution of India. The entire cause of action for filing the petition has arisen in Mumbai. We, therefore, transfer this petition to the original side. Consequential amendments shall be carried out by the petitioner within a period of one week from today.
