By this petition, the petitioner/original accused is challenging the Order passed by the learned Appellate Court rejecting his application for taking compilation of documents on record of the appeal.

Heard the learned Counsel appearing for the petitioner/original accused. He argued that the cheque was of the year 2011, but it was used in the year 2014 and the complaint came to be filed on the basis of that cheque. Therefore, it is necessary to file documents on the record of the Appellate Court. Gaikwad RD 1/2

(4)WPNo.152019.doc I have considered the submissions so advanced and also perused the impugned Order.

Perusal of the application does not show that the documents were part of the record before the learned Metropolitan Magistrate. Those were not filed during pedency of the trial and there seems to be no reason reflecting from the application, for not filing those documents during pendency of the trial.

In this view of the matter, no infirmity can be found in the impugned Order. The petition is devoid of any substance and the same is dismissed.
