The applicant is seeking pre-arrest bail in CR No.780 of 2019 registered with Sakinaka Police Station, Mumbai, registered on 30-92019 for offences under Sections 498A, 323, 504, 506 r/w 34 of Indian Penal Code.

The complainant is the wife of applicant. It is alleged that after marriage was performed between applicant and complainant on 24-4-2014, she was harassed by the applicant and subjected to mental and physical cruelty. The applicant was granted interim protection by this Court vide order dated 6-1-2020. 3.

Learned APP, on instructions and on the basis of report submitted by Investigating Officer, submitted that investigation is complete and charge sheet is filed against applicant on 25-3-2021. The report is taken on record and marked `X'

for identification.

The dispute has arisen due to matrimonial discord between parties. The charge sheet is filed. Hence, question of subjecting the accused to custodial interrogation does not arise. Hence, I pass following order :

ORDER

(i) The Anticipatory Bail Application is allowed and disposed of; (ii) Interim order dated 6-1-2020 is confirmed; (iii) In the event of arrest of applicant in CR No.780 of 2019 registered with Sakinaka Police Station, Mumbai, the applicant be released on bail on his executing PR bond in the sum of Rs.20,000/- with one or more sureties in the like amount.
