This Criminal Application is preferred by the Appellant-Accused for suspension of sentence and releasing him on bail during the pendency of the appeal. The Applicant-Accused is convicted of the offence punishable under Section 307 of IPC and is sentenced to suffer RI for 3 years and to pay fine of Rs.3000/- in default to undergo further RI for three months. It is seen that the Applicant-Accused was on bail during the pendency Shivgan 1/2

904-APPA-11-2017.doc of the trial. Injury of the victim appears to be simple injury in the nature of CLW admeasuring 4 cm X 1 cm. on right parietal region. In this view of the matter and considering the short sentence imposed on the Applicant-Accused, application is allowed. The Applicant-Accused be released on bail on executing PR Bond in the sum of Rs.15,000/- and on furnishing surety in the like amount till disposal of the appeal.
