This is an application for cancellation of anticipatory bail granted to respondent no.2 vide order dated 21st September, 2015, in C.R.No.I-262 of 2015, registered with Nerul Police Station, for the offence punishable under Sections 420 and 406 read with 34 of IPC. 2022.01.28 17:51:30 +0530 applicant, on instructions, submits that the case is listed for recording RAJESHRI PRAKASH AHER evidence and the next date before the trial Court is 31st January, 2022. On instructions, it is submitted that the applicants may be

rpa 2/2 7 appln 6 2016.doc allowed to withdraw this application. Applicants are victims. They were purchasers of fat and inspite of accepting the consideration, the building was not constructed till today. Hence, the trial Court may be directed to be concluded expeditiously.

In view of the submissions, I pass the following order: :: O R D E R ::

(i) Criminal Application No.6 of 2016, is allowed to be withdrawn, and, stands disposed of;

(ii) The proceedings in R.C.C.No.641 of 2017, arising out of C.R.No.I-262 of 2015, registered with Nerul Police Station, is expedited;

(iii) Trial Court shall conclude the trial expeditiously; (iv) Criminal Application No.6 of 2016, stands disposed of accordingly.
