By this civil application, the applicant seeks condonation of delay of 263 days in filing the first appeal, seeks recall of the order dated 17th September 2012 and restoration of the first appeal with consequential reliefs.

Delay in filing the first appeal is explained in civil application and more particularly in paragraph 8 of the civil application. The respondents were appearing before this Court all throughout. The applicant has made out a case for grant of reliefs as prayed. Civil application is made absolute in terms of prayer clauses (a) and (b). No order as to costs.
