This is an Application under Section 482 of the Code of Criminal Procedure, 1973 for quashing the chargesheet filed for the offences under Section 65E, 81, 82 and 83 of the Bombay Prohibition Act, 1949 and Sections 33(w) and 131(5) of the Bombay Police Act, 1951. The Application for discharge made by the Applicant has been rejected by the learned Magistrate. The said order has been confirmed by the Sessions Court in revision. The orders of the learned Magistrate and the Sessions Court have not been challenged by the Applicant.

The jurisdiction of this Court under Section 482 of CrPC is an extra ordinary jurisdiction which is to be exercised sparingly and in very rare cases. We, therefore, decline to entertain this Application. The Application is disposed of. However, this order will not preclude the Applicant from challenging the orders of the learned Magistrate as well as the Sessions Court on discharge Application.
