Heard the learned Advocate for the Applicant and the learned APP for the State.

The learned APP, on instructions, submits that the Investigating Officer proposes to file an Application under Section 169 of the Code of Criminal Procedure, 1973 qua the Applicant.

A report is tendered for the perusal of the Court. It is taken on record. 4.

This Court by an order dated 11 th January, 2022 has granted interim protection. It is likely that after the Investigating Officer files a report under Section 169 of the Code, the learned Magistrate may issue notice to the first informant and also pass an order for further investigation. Therefore, in order to obviate the possibility of the Applicant again facing the prospect of arrest, it may be appropriate to pass an order of pre-arrest bail.

Hence, the following order :

ORDER

(i) The Application stands allowed.

(ii) In the event of the arrest of the Applicant in C.R.No.330 of 2021 registered with Mahatma Gandhi Chowk Police Station, Miraj, he be released on bail on furnishing a PR bond in the sum of Rs.25,000/- and one or two sureties in the like amount.

(iii) The Applicant shall co-operate with the investigation and report to the Investigating Officer if directed.
