For the detailed reasons recorded in the order dated 07-01-2015 an ad-interim direction in terms of Section 438 of Code of Criminal Procedure was passed in favour of the applicant.

The prosecution in response to the said notice has filed reply. The reply does not reveal any reason repelling the reasons for which the adinterim direction was given i.e. there being no material against the applicant except himself Vishal 1/2

4-aba-23-2015 having taken the premises on Leave and Licence agreement for hotel business. Needless to add, the applicant was not found in the said premises at the time of raid.

Upon a specific query, learned APP fairly submitted that no other person including the victim girl has named the applicant as the person responsible for the activity for which the raid was carried out. In the said premises, ad-interim direction given on 07-01-2015 deserves to be and accordingly hereby confirmed on earlier terms and conditions.

However the applicant now shall attend the investigating officer only on the day on which he would be summoned by him for the purpose of investigation.

Application stands disposed of.
