By this application the applicant/accused apprehending arrest in C.R. No. 149 of 2014 registered with Khar police station, Mumbai for commission of offences punishable under Sections 409 and 420 of Indian Penal Code has prayed for pre arrest bail. The crime in question was registered upon the F.I.R. lodged by Assistant Administrator Technical Education.

The perusal of F.I.R. reveals the acts 1/4
were allegedly committed by the applicant during the period from 23-08-2011 uptil 03-01-2012. It reveals that same was lodged after the inquiry committed by a Committee. The said report is lodged regarding misappropriation made by the applicant to the tune of Rs. 48,910/-.

The learned APP has opposed the prayer for bail on the ground that specimen signatures of the applicant are yet to be obtained. Having regard to the same and having regard to the evidence pertaining to accusation being embodied in the document, it is difficult to perceive of there being any need of custodial interrogation of the applicant. It appears accordingly as learned APP on the instructions from the investigating officer has submitted that after considering the explanation given by the applicant as mentioned in his letter dated 08-12-2013 many of the matters from it are found to be correct during investigation.

Having regard to it, the application is allowed. The investigating officer of aforesaid crime is directed that in event of arrest of the applicant in connection with said crime, he be forthwith released on bail upon executing a P.R. Bond in sum of Rs. 50,000/- with one or two sureties to make like amount and subject to the conditions of the applicant, (i) staying at the address mentioned in the application and not changing the same without prior permission of this Court.
(ii) attending the investigating officer on every Monday in between 11.00 am to 1.00 pm.
and so also on any other day on which he would be summoned by the investigating officer for the purpose of investigation.
(iii) cooperating with the investigating agency for collection of specimen signatures in accordance with law.
(iv) not directly or indirectly making any 3/4
inducement, threat or promise to any person acquainted with the facts of the accusation against them so as to dissuade him/her from disclosing such facts to the investigating officer and (v) not misusing the protection granted by this order for fleeing away or for any other oblique purpose.
Application stands disposed of.
