1] This is an appeal fled against the judgment and order dated 12.01.1998 passed by the learned IInd Additional Sessions Judge, Kalyan in Sessions Case No. 961 of 1996, whereby the appellant has been convicted for the ofence punishable under Section 302 of the Indian Penal Code and sentenced to sufer R.I. for life and to pay fne of Rs.1,000/- and in default of payment of fne to sufer R.I. for six months. 2] Today, the learned APP has fled on record the report dated 11.02.2021 of Sr. Police Inspector, Ulhasnagar Police Station. The report shows that the appellant has expired on 05.06.2014 by jumping into Ulhas river and A.D.R. No. 94 of Dinesh Sherla 1/2

8-appeal 311-98.doc 2014 is registered at Mahatma Phule Chowk Police Station, Kalyan. The report is taken on record and marked as Article "X" .
