This is an Application filed under Section 438 of Criminal Procedure Code, 1973 for anticipatory bail.

The applicant is apprehending his arrest in Crime No.221 of 2022 registered at Poynad Police Station, District Raigad for the offences punishable under Sections 307, 143, 147, 148, 323, 506 of the Indian Penal Code, 1860 and Sections 37(1), 37(3) of the Maharashtra Police Act, 1951.

I have heard the learned counsel for the applicant and the learned APP for the Respondent - State.

According to the prosecution, on 18th December 2022, the present applicant alongwith the other co-accused assaulted the complainant and his friend Amol Patil and attempted to kill them due to some commercial dispute.

I have perused the injuiry certificate of injured Amol Patil. Nature of injury is simple.

Considering the overall facts and circumstances of the case, as there are no other criminal antecedents, I am inclined to release the Applicant on bail on following terms and conditions;

ORDER

(i) Anticipatory Bail Application is allowed.

(ii) In the event of arrest of the applicant in Crime No.221 of 2022 registered at Poynad Police Station, District Raigad for the offences punishable under Sections 307, 143, 147, 148, 323, 506 of the Indian Penal Code, 1860 and Sections 37(1), 37(3) of the Maharashtra Police Act, 1951, he shall be released on bail on furnishing PR Bond in the sum of Rs.25,000/- with one or more sureties in the like amount.

(iii) The applicant shall attend the concerned Police Station as and when called by the Investigating officer and shall co-operate in the investigation.
