Heard learned counsel for the applicant.

Learned counsel for the applicant pointed out that the applicant was arrested on 25/3/2018 for the ofences punishable under Sections 363, 366 of the Indian Penal Code and Sections 4, 6, 8, 10 and 12 of the Protection of Children from Sexual Ofences Act. The age of the victim is 14 years. At the relevant time the applicant was 28 years of the age.

Learned counsel for the applicant submits that the applicant is in custody for more than 40 months and the trial is yet to commence. He submits that considering that the arrest was made as far back as on 25/3/2018 and the applicant is in custody for more than 40 months, the trial be expedited.

As I am inclined to expedite the trial, learned counsel for the applicant seeks leave to withdraw the application. 5.

In view of the Covid-19 situation, I am not fxing any timeline but the trial Court is requested to proceed with the trial expeditiously.

The application is allowed to be withdrawn and disposed of as such.
