1) This is an application for modification of condition no.2 imposed upon the applicant while releasing him on bail by an order dated 31.3.2015 by this Court in Bail Application No. 2657/2014. 2) The applicant while releasing the applicant on bail by the said order dated 31.3.2015 has imposed condition that the applicant shall not enter the jurisdiction of Vikhroli Police Station where the family members of the deceased reside. The learned counsel for the applicant submitted that the applicant is a student of Sandesh Vidyalaya and Junior College of Arts, Science and Commerce and intends to appear for the HSC examination which is scheduled to be held on 18.2.2016 for the oral examination and other related examination including practical examination will be conducted between 20.1.2016 till the date of final examination. In the
2 /3 912-APPP-2-2016 circumstances, the applicant has prayed to modify the said condition.
3) The learned APP has produced a letter dated 14.1.2016 issued by the Principal of the aforesaid charge to the Senior Inspector of Police, Aarey Police Station, Mumbai wherein the aforesaid facts by the learned counsel for the applicant have been reaffirmed. As per the said letter dated 14.1.2016 the process of issuance of hall tickets will begin on 27.1.2016 and the examinations of the applicant would come to an end on 4.3.2016. In view of the above, I am inclined to modify the condition permitting the applicant to enter the jurisdiction of Vikhroli Police Station from 9:00 a.m. of 20.1.2016 till 6:00 p.m. of 4.3.2016 for the purpose of attending the college and the examinations.
4) Hence, the following order:
ORDER:
1) The applicant is hereby permitted to enter the jurisdiction of Vikhroli Police Station from 9:00 a.m. of 20.1.2016 till 6:00 p.m. of 4.3.2016 for the purpose of attending the college and for appearing the examinations.
2) During the said period from 20.1.2016 till 4.3.2016 the applicant shall not visit the vicinity where the relatives of the deceased are residing.
3) The applicant shall not indulge in any criminal activity during the said period and shall withdraw himself from the jurisdiction of Vikhroli Police Station on or before 4.3.2016 at 6:00 p.m. If the applicant commits any breach or default of the aforesaid conditions, the police are at liberty to seek cancellation of the modification
