P.C.:- 1) Learned APP on instructions from Superintendent of Kolhapur Central Prison submitted that, as of today the Petitioner has undergone actual imprisonment of 11 years, 10 months and 18 days and including remissions has undergone 12 years, 11 months and 22 days in incarceration.

2) It is thus clear that, the Petitioner has not yet completed minimum actual imprisonment of 14 years as a convict. 3) In view of the above, learned Advocate for the Petitioner seeks leave to withdraw Petition with liberty to file an Application after the Petitioner completes 14 years of actual imprisonment as a convict. Leave and liberty granted.
