M/s.Crawford Bayley & Company appeared and submitted that Respondent is no more and Appellant has taken out Civil Application to bring legal representatives of the Respondent on record of the First Appeal. Hence, the matter was adjourned. Today both the Advocates are heard. Admittedly, the valuation of First Appeal is below Rupees One Crore. In view of this, the Appeal needs to be transferred to District Court.

Advocate Aditi Shukla submitted that, she is objecting such transfer on behalf of the legal representative of Respondent. However, as on today such legal representative of Respondent No.1 are not on record and therefore, submission on their behalf cannot be considered. Hence, Appeal be transferred to the District Court in view of the office note dated 20/02/2016.
