DATED :- APRIL 25, 2016 P.C. :- 1) Initially, when these petitions were placed for admission today, we were inclined to admit them. Hence, we merely issued Rule. However, in the afternoon session, the parties brought to our notice a development and which is in the J.V.Salunke,PA

26-WP.189.2014+.doc form of an order passed in a batch of appeals. That order decides the very issue and question. Hence, a request was made to dispose of these petitions.

2) The parties agree that the issue and controversy raised in these writ petitions is identical to the one dealt with and considered in a batch of appeals being Central Excise Appeal No.268 of 2014 (The Commissioner of Central Excise, Pune-I vs. M/s. Mahindra Navistar Automotives) and connected appeals, decided on 8th February, 2016. One of us (S. C. Dharmathikari, J.) was a party to this order in the Central Excise Appeals. 3) Since the Central Excise Appeals and the present petitions raise the same issue and question, each of these petitions are disposed of in terms of the judgment in the batch of appeals. Ordered accordingly. There would be no order as to costs.
