This is an application for condonation of delay of 167 days in filing the application.

The Appeal is filed at the instance of BMC. In the Application it is stated that due to shortage of staff and heavy workload in the legal department, the Appeal could not be filed within time stipulated. There has been delay of 167 days. It is not intentional.

The application is opposed by the learned counsel for the respondent by filling affidavit in reply.
