The applicant was granted bail by order dated 6th December, 2018 passed by this Court in BA No. 1617 of 2018. He was directed to furnish P.R. Bond in the sum of Rs.50,000/- in the like amount. The applicant was also permitted to furnish cash security in the sum of Rs.50,000/- for a period of four weeks. The applicant has furnished cash security and has been released on bail. It is submitted that applicant is not in a position to make arrangement for sureties in the sum of Rs.50,000/- and the same
Sknair 504-appp-4-19.odt may be reduced to Rs.30,000/- and the facility of cash bail be extended further for a period of four weeks. Learned APP submitted that the applicant is the main accused. 3.
Applicant was granted bail on the basis of reasons assigned in order dated 6th December, 2018. It is submitted by the counsel for the applicant is charged for offence under Section 376 of Indian Penal Code and therefore, he is finding it difficult to arrange surety. However, he would be able to arrange surety if amount of surety is reduced to Rs.30,000/-. In view of the submissions, I pass the following order.
ORDER
i.
Order dated 6th December, 2018 passed in Criminal Bail Application 1617 of 2018 is modified to the extent that the applicant be released on bail on furnishing PR Bond in the sum of Rs.30,000/- with one or more sureties in the like amount. ii.
Cash facility granted to the applicant vide order dated 6th December, 2018 is extended by a period of four weeks. iii.
Application stands disposed off.
