Heard learned counsel appearing for the parties. 2.

For the reasons to be recorded separately, the impugned order passed by the Additional Commissioner Pune Division, Pune in RTS Appeal (Revision) No.88 of 2017 is quashed and set aside. 3.

The aforesaid appeal is restored to its original file before the Additional Commissioner, Pune Division, Pune. 4.

The Additional Commissioner will hear the appeal on its own merits and decide the same as expeditiously as possible however within three months from the first date of appearance of the parties before the said authority.

The parties to appear before the Additional Commissioner on 8th May,2019.

This court has not expressed any opinion on merits of contentions raised either by the petitioner or the respondents and it is for the Additional Commissioner to decide the appeal on merits. 7.

The ad-interim relief granted by this court shall remain in force till 10th May,2019.

It will be open for the petitioner to apply for ad-interim relief before the said authority.
