After hearing the respective counsel and the learned APP, it is noticed that there are 3 complaints of which cognizance was not taken by the police authorities, still are pressed into service and relied upon for modifying the conditions of Bail, thereby debarring him from entering in the Thane district.

2 22.6.18 apl The fact remains that applicant and complainant are residing in the same building. Keeping in mind that the applicant is already charge-sheeted and both of them are residing in the same building, condition no. 2 of the order dated 16/12/2017 stands modified as under:
Applicant shall not enter within the limits of Kashimira Police Station except for attending the Court proceedings. Once the charge is framed against the accused, the Court will be at liberty to modify the aforesaid condition, if so requested. Application stands disposed of.
