Learned APP invited our attention to the communication dated 23rd July 2021. By the said communication, it is informed to the ofÏce of learned public prosecutor that in the process of service of bailable warrant against the sole respondent, namely, Bhaskar Shantaram Shelke, it is revealed that respondent - Bhaskar Shantaram Shelke had expired on 3rd December 2010, who was suffering from ailment. Photocopy of the death certificate issued by the competent authority is annexed to the communication. The certificate is duly signed by the issuing authority. A copy of the said communication dated 23rd July 2021 is also addressed to the ofÏce of Registrar, City Sessions Court, Greater Bombay and the Assistant Registrar, Criminal Appeal Department, High Court of Bombay.

In view of the above referred facts, the appeal abates. The appeal is accordingly disposed of.
