We are informed that the physical possession of the secured asset is scheduled to be taken on 15 January 2019. Inasmuch as the Petitioner has an alternate remedy before the DRT, we are not inclined to entertain the Petition.

Learned Counsel for the Respondent No.1-Bank has handed over a copy of the order passed by the District Magistrate, Pune, under section 14 of the SARFAESI Act, to the learned Counsel for the Petitioner in Court. 3.

The Petition to stand dismissed with liberty to the Petitioner to resort to the alternate remedy.
