This an application for bail filed by the aforesaid Applicant, who has been arrested in Crime No.405 of 2015 registered at Foujdar Chavadi Police Station, District-Solapur, for offences punishable under sections 397, 504 and 506 of the Indian Penal Code and section 135 of the Bombay Police Act.

The accusations against the Applicant, in brief are that on 17.11.2015 at 11.30 p.m. the Applicant alongwith others had inflicted grivous injury on one Suraj Patil-complainant and that he committed theft of gold chain and money of said Suraj. The learned APP has Megha 1/2

8_ba_17_2016 placed on records list of six cases pending against the Applicant. 3.

I have perused the records and considered the submissions advanced by the learned counsel for the Applicant and the learned APP for the Respondent -State. The FIR prima facie reveals that the Applicant had inflicted head injury on the complainant by means of a sword. The medical certificate prima facie reveals that the complainant had sustained injury on the vital part of the body. The investigation is still in progress.

Considering the above facts, in my considered view the Applicant cannot be released on bail at this stage. Hence, the application is dismissed with liberty to the Applicant to file fresh application upon completion of the investigation. (ANUJA PRABHUDESSAI, J.) Megha 2/2
