This is an application for bail in connection with C.R. No. 952 of 2020 registered with Andheri Police Station for offences punishable under Sections 370(3) r/w. 34 of Indian Penal Code, 1860 ("IPC" for short) and Sections 4 and 5 of Prevention of Immoral Traffic (Prevention) Act, 1956 ("PITA" for short). The applicant was arrested on 15th December, 2020. 2.

The case of the prosecution is that the information was received by police that one lady is in the business of supplying girls Digitally signed by RajeP. Aher Date:

2021.01.21 14:14:29 +0530 for sexual gratification and hence the team including the RajeP.

Aher complainant decided to conduct raid to verify the information. Bogus customer was arranged. Interaction was conducted with the

lady who was involved in the trafficking. The rooms were booked by the bogus customer in the Hotel Dragonfly and during the raid lady namely Seema was apprehended. The role that has been attributed to the applicant is that he was allegedly working as Manager in the hotel. Rooms were booked in the hotel. The applicant had allegedly provided entry to co-accused without verification. 3.

On perusal of the documents on record, it is apparent that the room was booked in the name of bogus customer. The information received by the police, does not involve the applicant as a person involved in trafficking. Even during the raid, it was not found that the applicant had any connection with illicit trafficking. The applicant is in custody from 15th December, 2020. Further detention of the applicant is not warranted.

Hence, I pass the following order.

O R D E R

i) Bail Application No. 70 of 2021, is allowed;

ii) The applicant is directed to be released on bail in connection with C.R. No. 952 of 2020 registered with Andheri Police Station on furnishing P.R. bond in the sum of Rs. 25,000/-(Twenty Five Thousand) with one or more sureties in the like

amount;

iii) The applicant shall report concerned police station once in a month on first Saturday of month till filling of charge-sheet and thereafter once in two months on first Saturday between 11.00 am. to 1.00 pm. till further order;

iv) The applicant is permitted to furnish provisional Cash Bail Security in the sum of Rs.25,000/- for a period of twelve weeks in lieu of surety;

v) Bail Application stands disposed of accordingly. vi) Secretary/Personal Assistant of this Court. All concerned will act on production by fax or email (PRAKASH D. NAIK, J.)
