Since principally the order dated 20/09/2017 passed by the learned Metropolitan Magistrate, 23rd Court, Esplanade, Mumbai is under challenge, the challenge to the said order by way of a Writ Petition is misconceived. Upon this, the learned counsel appearing on behalf of the Petitioners Shri Rajendra Shirodkar states that the Petitioners would invoke the appropriate remedy under the Criminal Procedure Code. Needless to state that if any such remedy is invoked, the same would be tried on its own merits and in accordance with law. The above Writ Petition is accordingly disposed of. If the issue of limitation arises, the fact that the above Writ Petition was filed in this Court on 08/02/2017 and is pending up to the date of passing of the instant order would be taken into consideration by the concerned Court.
