Learned counsel for the petitioner seeks leave to withdraw the petition as he has already filed discharge application before the trial Court. Leave is granted. The petition is dismissed as withdrawn.

The learned Special Judge, Thane is directed to decide the discharge application filed by the petitioner in NDPS Special Case No.22/2013 as expeditiously as possible and preferably within a period of three months from the date of the receipt of this order. It is made clear that this order should not be construed as expression of any opinion by this Court and the learned Special Judge, Thane shall decide the discharge application on its own merits and in accordance with the law.
