The first bail application filed by this applicant was rejected by this court vide order dtd. 22/09/2014 passed in Criminal Bail Application No.1409 of 2014 with Criminal Application No.588 of 2014 in Criminal Bail Application No.1409 of 2014. The present bail application is pressed by the applicant on the ground of change in circumstances.

According to the Ld. Counsel for the applicant, the change in circumstance is that the trial has began and one of the recovery Purti Parab

2 39 - BA No.15-19.doc panchas has been examined. According to Ld. Counsel, the pancha has not supported the prosecution case. In my view, this cannot be termed as change in circumstance. There are other witnesses which are to be examined including Investigating Officer. Investigating Officer can throw light on discrepancies in the evidence of the pancha. 3.

Considering the fact that by the reasoned order dtd.22/09/2014 applicant's bail application was rejected, I am not inclined to entertain this application, as in my view there is no substantive change in circumstance to enable the applicant to approach this court again. Hence, the following order.

ORDER
