It is alleged that employee of the complainant, Jahangir Shaikh, committed theft of the property described in the complaint, worth Rs.77,38,500/- from the complainant's clinic. Jahangir Shaikh and two others were arrested and released on bail. Learned APP on instructions from the Investigating Ofcer submits that the stolen property, has been recovered and handed over to the Shivgan 1/3

complainant.

Applicant alleged to have joined, Jahangir in the commission of ofencee however, his name is not disclosed in the complaint.

Be that as it may, since the stolen property is recovered at the instance of the accused no.1 and same being returned to the complainant, in my view, custodial investigation of the applicant is not required. It is further reported that there are no criminal antecedents against this applicant.

In view of the facts of the case and for the reasons stated, application is allowed.

In the event of arrest of the applicant in Crime No.334 of 2019 registered with Kandivali Police Station , he shall be released on executing PR bond for the sum of Rs.25,000/- with one or more local sureties in like sum. He shall attend the concerned police station twice a month on third and fourth Monday between 11 a.m. to 1 noon till charge-sheet is fled.

He shall give particulars of his permanent residential address and contact number to the Investigating Ofcer, forthwith.
