Mr. Vijay Badgujar, the learned counsel for the Respondent No.4 has submitted that the Appellant, who is the plaintiff in the Suit has already withdrawn the Civil Suit No.2436 of 2012 and that in view of withdrawal of the said suit the appeal from order has rendered infructuous. He has placed on record copy of the case status report of the Civil Suit No.2436 of 2012, which is taken on record and marked 'X' for identification. Perusal of which reveals that the Appellant has withdrawn the said suit. 2.

In the light of above, the appeal from order has rendered infructuous and is accordingly disposed of.
