It is alleged that the applicant had introduced Ritesh Dipak Nakhwa to the complainant through his brother-in-law from whom complainant had purchased a fat in chawl known as Ganpat Chandi House at Versova Village, Andheri (West) for a consideration of Rs.11 Lakhs. Document in the form of sale deed executed by Ritesh Dipak Nakhwa shows, consideration was received by Ritesh Shivgan 1/3

Dipak Nakhwa. Later, it was revealed that the said chawl was unauthorised. In the back-drop of the aforesaid facts, complainant lodged report with Versova Police Station and thereupon Crime No.295 of 2019 came to be registered under Section 420 read with Section 34 of the Indian Penal Code, 1860.

In view of the facts of the case and the role attributed to the applicant, prima-facie, it appears, entire consideration has been received by Mr. Ritesh Dipak Nakhwa from the complainant.

Thus, taking into consideration facts of the case and upon perusal of the documents, in my view, custodial interrogation of the applicant is not required. Charge-sheet has already been fled. The learned APP on instructions reported that there are no criminal antecedents against this applicant.

In view of the facts of the case, following order: (i) In the event of arrest of the applicant in Crime No.295 of 2019 registered with Versova Police Station, he Shivgan 2/3

shall be released on executing PR bond in the sum of Rs.25,000/- with one or more sureties in like amount. (ii) He shall attend the concerned police station twice a month on 2nd and 4th Monday between 11 a.m. to 1 noon commencing from January, 2020 till the charge is framed. (iii) He shall give his permanent residential address and mobile contact number to the Investigating Ofcer . (iv) He shall co-operate in the investigation.

(v) The applicant shall not tamper with the evidence or attempt to infuence or contact the complainant, witnesses or any person concerned with the case Application stands disposed of.
